Obra
Terms of service
The parties
These terms are between Obra, of San Ignacio, Cayo, Belize, and the company that subscribes to the service (“you”). The people you invite into your account use it under these terms as your members. Where a signed agreement between you and Obra (an implementation or development agreement, or a proposal you accepted) says something different, the signed agreement wins.
What Obra is
Obra is construction management and cost control software: estimating, labor and crews, receipts and matching, cost overview and budget, client billing and AI bid review, turned on per company as modules. It is not an accounting system, and it is not legal, tax or engineering advice. Your accountant, lawyer and engineer remain yours.
Accounts and members
Your Owner manages your members and their roles. Keep credentials private, use real names and tell Obra at once if you think an account has been compromised. You are responsible for what your members do in your account.
Fees
The subscription is priced per company, per month, by the modules you turn on, in Belize dollars, as quoted to you. Onboarding and any founding terms are governed by the signed implementation agreement. GST is added where it applies. Obra gives 30 days’ notice of a change to the monthly fee. If an invoice is unpaid 30 days after its due date, Obra may suspend access after a written reminder, and restore it when the account is settled.
Your data
Your data is yours. Obra has only the licence it needs to run the service for you. You can export your estimates, budgets, documents and registers in Excel and PDF at any time. When the subscription ends you have 90 days to export, after which your data is deleted as the Privacy Policy describes.
Acceptable use
Do not upload content you have no right to, use the service for anything unlawful, resell it, or probe, overload or try to break it. Obra may suspend an account that does, after notice where notice is practical.
AI features
Bid review and document reading produce suggestions. A person accepts every number; nothing changes in your records until a member says so. Obra is not liable for a decision made on a suggestion no one reviewed.
Availability and support
Obra works to keep the service available and tells you ahead of planned maintenance. Support is by WhatsApp and email during Belize working hours. There is no uptime guarantee unless your signed agreement contains one.
Intellectual property
Obra owns the software, its design and its documentation. You own your data and the documents you produce with it.
Warranty and liability
Beyond what a signed agreement promises, the service is provided as is. To the extent the law allows, Obra’s total liability to you in any twelve-month period is limited to the fees you paid Obra in those twelve months, and Obra is not liable for indirect or consequential loss, including lost profit or a lost bid.
Termination
Either side may end the subscription with 30 days’ written notice. Obra may end it immediately for a material breach that is not cured within 14 days of notice. The export window above applies either way.
Governing law
These terms are governed by the laws of Belize, and the courts of Belize have jurisdiction. Talk to us first; most things are solved in a conversation.
Changes to these terms
Obra may update these terms by posting the new version here and emailing account holders 30 days before it takes effect. Using the service after that date is acceptance of the new terms.
